Case against Karr dropped: no DNA link to JonBenet Ramsey murder

Prosecutors have withdrawn their case against John Mark Karr, the man who confessed to killing JonBenet Ramsey in 1996, as DNA tests do not place him at the crime scene.

“The people would not be able to establish that Mr. Karr committed this crime despite his repeated insistence that he did,” District Attorney Mary Lacy said in court papers. Lacy also said that prosecutors found no evidence placing Karr in Boulder at the time of the killing. She also vowed to keep pursuing leads in the murder, saying, “This case is not closed.”

Karr will remain in custody in Boulder until he can be sent to Sonoma County, Calif., to face child pornography charges dating from 2001.

According to reports by MSNBC and KUSA, a local television station in Denver, Colorado, tests performed on DNA samples taken from Karr do not match samples recovered from Ramsey’s body.

On its website, KUSA says it “has confirmed from two sources that the DNA taken from John Mark Karr, 41, does not match the DNA samples taken from the crime scene in the JonBenet Ramsey murder case. No charges will be filed against Karr in connection with the Ramsey case by the Boulder County District Attorney’s office.”

DNA from Karr’s hair and saliva were tested in the Denver, Colorado Police Department’s lab over the weekend.

“This information is critical because … if Mr. Karr’s account of his sexual involvement with the victim were accurate, it would have been highly likely that his saliva would have been mixed with the blood in the underwear,” said Colorado District Attorney, Mary Lacy. Lacy noted that Karr had become a suspect after exchanging e-mail with a professor in California.

Karr’s attorney has requested that all DNA evidence be handed over to the defense for examination. His attorney has also requested additional testing of Karr’s DNA; however, there is confusion about who represents Karr. Seth Temin, a public defender claims to represent Karr, but at least two other attorneys in California, Jamie Harmon and Patience Van Zandt, are also claiming to represent him.

“The warrant on Mr. Karr has been dropped by the district attorney. They are not proceeding with the case,” said Timen. “We’re deeply distressed by the fact that they took this man and dragged him here from Bangkok, Thailand, with no forensic evidence confirming the allegations against him and no independent factors leading to a presumption he did anything wrong,” added Timen.

JonBenét, a beauty queen, was found beaten and strangled to death in her Colorado home on the day after Christmas in 1996.

In a press conference earlier this month, Karr confessed to being with JonBenét when she died, adding that her death was an accident. “I was with JonBenét when she died. I loved JonBenét. She died accidentally. I am so very sorry for what happened to JonBenét. It’s very important for me that everyone knows that I love her very much, that her death was unintentional, that it was an accident.”

Despite his confession, Karr’s then ex-wife said that he was in Alabama with her when the murder occurred.

Australian TV network sprung fabricating live crosses by rival

Australia’s Nine Network has issued an apology after the rival Seven Network caught Nine News fabricating live crosses to the search site for murdered schoolboy Daniel Morcombe. The network issued a statement after Saturday and Sunday’s Nine News bulletins in Brisbane, which featured presenter Eva Milic crossing “live” to the site with the caption: “Near Beerwah”.

The rival Seven Network, based nearby, lifted the lid on the scam after filming the Nine News chopper almost 100 kilometres south of Beerwah – on the helipad outside the studio, with lights on and blades in motion while Cameron Price reported from inside. Nine admitted to faking Sunday’s cross; issuing a statement on Monday blaming bad weather.

“Our chopper was forced to divert from Beerwah due to bad weather, and air control instructed them to touch down,” it read.

The network also told media industry website mUmBRELLA that “the producer was unaware until it was too late to abort or delay the cross”.

Doubts have been cast over the truth of this statement, however, as it has since emerged that the chopper was also absent from Beerwah on Saturday, and was in fact circling Brisbane’s western suburbs during Melissa Mallet’s report. Director of Queensland Seven News, Rob Raschke, questioned the merit of Nine’s claims, telling Brisbane’s Courier-Mail, “the idea of not knowing where a $3 million helicopter is defies belief”.

A revised statement yesterday announced a Nine investigation into why the location of the helicopter was misreported on both nights, describing the situation as “unacceptable”.

Dan Savage wins Webby Award for It Gets Better Project

Dan Savage, author of the sex advice column Savage Love, has won a Webby Award for his work on the It Gets Better Project. He started the project in 2010 to address a series of incidents of suicide among LGBT youth.

Savage and his husband, Terry Miller, co-edited a book featuring selections from the It Gets Better Project. The book, It Gets Better: Coming Out, Overcoming Bullying, and Creating a Life Worth Living, includes a piece from President of the United States Barack Obama – who also filmed a video for the online project. In both the book and the online project itself, individuals submitted contributions with messages of hope and optimism directed towards LGBT teenagers.

In an interview published Thursday with Fenuxe Magazine, Savage commented on his initial response when contacted by the Obama Administration to receive a video contribution from the President for the It Gets Better Project: “You could have knocked me over with a feather when the White House called and said the President would record a video. And they not only recorded a video, they were calling me to let me know and they were giving it to us first to release on the ‘It Gets Better’ website.”

The Webby Award is presented anually by the International Academy of Digital Arts and Sciences, for excellence on the Internet. Savage was selected for recognition with a Special Achievement Award for his work on the It Gets Better Project. His project focuses on combatting bullying directed against teenagers who identify as lesbian, gay, bisexual, and transgender.

HIV-positive man receives 35 years for spitting on Dallas police officer

An HIV-positive man was sentenced to 35 years in prison Wednesday, one day after being convicted of harassment of a public servant for spitting into the eye and open mouth of a Dallas, Texas police officer in May 2006. The United States Centers for Disease Control and Prevention says that no one has ever contracted HIV from saliva, and a gay-rights and AIDS advocacy group called the sentence excessive.

A Dallas County jury concluded that Willie Campbell’s act of spitting on policeman Dan Waller in 2006 constituted the use of his saliva as a deadly weapon. The incident occurred while Campbell, 42, was resisting arrest while being taken into custody for public intoxication.

“He turns and spits. He hits me in the eye and mouth. Then he told me he has AIDS. I immediately began looking for something to flush my eyes with,” said Waller to The Dallas Morning News.

Officer Waller responded after a bystander reported seeing an unconscious male lying outside a building. Dallas County prosecutors stated that Campbell attempted to fight paramedics and kicked the police officer who arrested him for public intoxication.

It’s been 25 years since the virus was identified, but there are still lots of fears.

Prosecutors said that Campbell yelled that he was innocent during the trial, and claimed a police officer was lying. Campbell’s lawyer Russell Heinrichs said that because he had a history of convictions including similarly attacking two other police officers, biting inmates, and other offenses, he was indicted under a habitual offender statute. The statute increased his minimum sentence to 25 years in prison. Because the jury ruled that Campbell’s saliva was used as a deadly weapon, he will not be eligible for parole until completing at least half his sentence.

If you look at the facts of this case, it was clear that the defendant intended to cause serious bodily injury.

The organization Lambda Legal (Lambda Legal Defense and Education Fund), which advocates for individuals living with HIV, says that saliva should not be considered a deadly weapon. Bebe Anderson, the HIV projects director at Lambda Legal, spoke with The Dallas Morning News about the sentence. “It’s been 25 years since the virus was identified, but there are still lots of fears,” said Anderson.

The Dallas County prosecutor who handled the trial, Jenni Morse, said that the deadly weapon finding was justified. “No matter how minuscule, there is some risk. That means there is the possibility of causing serious bodily injury or death,” said Morse. Dallas County District Attorney Craig Watkins stated: “If you look at the facts of this case, it was clear that the defendant intended to cause serious bodily injury.”

Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.

A page at the CDC’s website, HIV and Its Transmission, states: “HIV has been found in saliva and tears in very low quantities from some AIDS patients.” The subsection “Saliva, Tears, and Sweat” concludes that: “Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.” On Friday the Dallas County Health Department released a statement explaining that HIV is most commonly spread through sexual contact, sharing needles, or transfusion from an infected blood product.

Efforts to salvage Indonesian naval vessel grounded off Queensland, Australia hampered by stormy weather

Efforts to salvage the Indonesian naval vessel Arung Samudera from where she ran aground on the Sunshine Coast Queensland, have been delayed due to poor weather conditions.

The 35-metre, tri-masted vessel was originally grounded on August 23 in stormy weather at Inskip Point, near Rainbow Beach. A salvage contractor has being brought in to rescue the stricken vessel, her hull is intact and it is believed the ship is in no imminent danger of breaking apart.

However, the tall ship did drag its anchors and break its rudder and centreboard during the beaching.

Australian Navy Commander Forbes Peters says that although salvage has been postponed until early next week, the vessel will be surveyed today by the salvage firm.

“To develop a plan for how they would salvage the vessel of the beach, that’s going to involve a tugboat pulling the thing off the beach with a longline.

“The trouble with actually conducting the salvage will be the sea state… Until the weather abates there really will not be able to do much in terms of salvage,” he said.

The 18-man crew – six officers and 12 sailors – of the New Zealand-built vessel have managed to retrieve their belongings from the ship, and are now expected to be transported to temporary accommodation in local barracks in Bulimba, Brisbane.

It is still hoped the ship can be repaired in time for it to attend a summit next month in Sydney, but this to be unlikely. A decision on whether to take her to Brisbane or Gladstone for repairs is expected to be made on Monday.

Small plane crashes in central Berlin

A small single-engine ultralight aircraft has crashed on a lawn between the Reichstag building, the seat of the German parliament, and the Bundeskanzleramt, the seat of the chancellor, in Berlin. The aircraft crashed at approximately 2000CET. Amateur footage aired by the ARD shows the plane rapidly descending before crashing on the lawn and bursting into flames. Witnesses at the scene were inconclusive about the heading of the plane. Some stated that it was targeting the Reichstag while others said that the pilot tried to steer away from it. He was killed in the crash. People near the scene attempted to fight the fire with hand-held extinguishers, however the aircraft was mostly destroyed by the time the emergency services arrived.

The German authorities have ruled out terrorism. Police are saying that the pilot’s wife has been missing since Monday and they had suspected that he might have something to do with the disappearance. It is possible that he might have committed suicide to avoid prosecution.
