US Supreme Court upholds ban on partial birth abortions

The Supreme Court of the United States on Wednesday April 18 has upheld the federal Partial-Birth Abortion Ban Act of 2003. The 5-4 vote reflected the change in vote count resulting from the retirement of Justice O’Connor and the confirmation of Chief Justice Roberts and Justice Alito.

The Intact dilation and extraction procedure, also known as partial birth abortion, involves removing an intact late-term fetus from the womb via the cervix. While it is a relatively rare operation – 0.17% of all abortions in the US in 2000, it has become a focal point in the abortion debate.

The Partial-Birth Abortion Ban Act bans the procedure in cases where the fetus is terminated during the operation, unless it is performed to to save the life of the mother.

Justice Kennedy wrote in the opinion of the court: “respondents have not demonstrated that the Act would be unconstitutional in a large fraction of relevant cases.” Further, he said, “Respondents have not demonstrated that the Act, as a facial matter, is void for vagueness, or that it imposes an undue burden on a woman’s right to abortion based on its overbreadth or lack of a health exception. For these reasons the judgments of the Courts of Appeals for the Eighth and Ninth Circuits are reversed.”

In a concurring opinion, Justice Thomas stated that he joins “the Court’s opinion because it accurately applies current jurisprudence, including Planned Parenthood of Southeastern Pa. v. Casey, 505 U. S. 833 (1992).”

In dissent Judge Ginsburg wrote: “Today’s decision is alarming. It refuses to take Casey and Stenberg seriously. It tolerates, indeed applauds, federal intervention to ban nationwide a procedure found necessary and proper in certain cases by the American College of Obstetricians and Gynecologists.”

Justice Kennedy’s words also recall the complicated issues of standing related to such cases. An issue in Roe v. Wade was the impossibility of any individual having standing in a court proceeding regarding abortion rights, since court proceedings take more than the 9 months of pregnancy, retiring any individual plaintiff’s standing before an appeals process can take place. The criterion of “a large fraction of relevant cases” may effectively deny standing to any plaintiffs who wish to litigate particular restrictions in some relevant future cases.

Wikinews held an exclusive interview with Jeremy Hanke, editor of MicroFilmmaker Magazine. The magazine, which is free to read online, was started as a resource for the low budget moviemaker and features book, independent film, equipment and software reviews as well as articles on film distribution, special effects and lighting.

He says that one of the goals of the magazine is to “connect low-budget filmmakers via a feeling of community, as many…..often compete so viciously against one another in film festivals for coveted “shots” with Hollywood, that they can quickly forget their similarities.”

When asked if films made on a shoestring budget can really compete with those made for millions of dollars, he replied, “no…yes…and absolutely. Allow me to explain.” And so he does in the interview below.

Jason-2 satellite launched to measure sea levels

The Ocean Surface Topography Mission (OSTM), or Jason-2, satellite, has been launched into low Earth orbit. A Delta II rocket carrying the satellite lifted off from Space Launch Complex 2W at the Vandenberg Air Force Base in California, United States, at 07:46 GMT this morning. Spacecraft separation occurred around an hour later, and the solar panels on the satellite have deployed.

OSTM is a collaboration between the American space agency, NASA, and the French space agency, CNES. It will study and map the surface of the oceans from space. The Delta II rocket flew in the 7320 configuration, the lowest capacity variant, with three solid rocket motors, and no third stage. The exact launch time was 07:46:25.192 GMT.

This is the third launch of a Delta II carrier rocket to be conducted so far this year, and the 137th overall. The next Delta II is scheduled to launch in mid-late August, with the GeoEye-1 civilian imagery satellite, however A GPS satellite launch which was delayed from mid July to an unconfirmed date could potentially occur before this. This is the 32nd orbital launch of 2008.

Press releases are such useful tools! Here’s how to write one specifically for an upcoming event. The basic principles, however, apply to writing any press release.

Step 1: Identify your hook

Remember that a press release is just that: information you are releasing to the media in hopes that your story will be published and read by large numbers of people. Frequently, a press release that goes on line will stay on line, to be read by people long after your event has occurred.

So, in order to make your story attractive to the media, you need to identify an angle on your event that people are likely to want to read. For example, a fund-raising auction may or may not be of interest to the general public. What is it about your particular auction that is valuable to readers? Is the money going to a valuable cause? Will your auctioneer be a famous fellow with a terrific skill at bid-calling, an entertainment in himself? Will there be a big selection of weekend vacation homes?

Step 2: Essential information

Once you have figured out your “hook,” you can put down the essentials: who the release is written for or about, contact information, when it’s OK to publish the information, and what the title and date are.

Note that your title is the first spot to mention your hook. “Annual hospital auction” simply will not do. In the above case, while there may be many other items up for bid, the haunted mansion is probably the most exciting possibility, and it’s highly likely that readers will want to know more-and keep reading.

Step 3: The meat of the release

Make your opening statement a direct follow-up to your title. In the example we’re talking about, for example, you might open with “Edgeport Hospital’s annual auction offers an overnight visit to the Sloane Mansion and its ghosts.” Then develop this idea with your most interesting information about the mansion and the auction.

In an additional paragraph or two, provide more information that is less essential but still of interest, including, for example, who the caterer is, how long the hospital has been holding an auction, what the money goes for, what some of the other items are, whether the auction is formal or informal, etc.

Conclude with everything people need to know about how to participate in the auction, including how to register or buy tickets, ticket prices, phone numbers, email addresses or internet links, when and where the event occurs, and anything else people should know in advance.

Follow these steps and your press release should grab your media contacts-and garner the publicity you need for your event.

Californian computer company lodges antitrust suit against Microsoft

Tuesday, February 21, 2006Tangent Computer, a computer services and hardware company based in Burlingame, California has filed a lawsuit against Microsoft. The lawsuit filed on February 14, 2006 claims that Microsoft continues to breach federal antitrust laws.

Tangent alleges that Microsoft fosters tactics “to prevent and destroy competition” while raising prices of its software to “supra-competitive levels.” Tangent is arguing that the tactics are a violation of section 2 Sherman Antitrust Act, a federal law prohibiting unfair business practices and monopolies.

The lawsuit details legal issues which have faced Microsoft since the 1980s, and requests that an amount of monetary damages to be determined by a jury at a trial.

Tangent is an original equipment manufacturer who has purchased and installed Microsoft operating systems since 1995. In addition to their hardware business, they also provide Internet content monitoring, spam filtering, anti-spyware and adware solutions, network vulnerability assessments, active directory tools and migration services.

38 miners killed in Russian mine explosion

At least 38 miners are dead after methane exploded in an underground coal mine in Russia. 180 people made it out of the mine, and at least 7 of those were seriously injured. At least 217 miners were inside when the explosion occurred.

“Up to 45 people could have been at the epicenter of the blast. One hundred and eighty people have been brought out. Of these, five have life-threatening injuries. The fate of the other [trapped] miners is unknown. According to the (mining) company’s information, there were 194 workers and 23 engineering inspectors underground [when the mine exploded],” said a spokesman for Russia’s Emergency Ministry.

The explosion occurred at the Yubileynaya (Jubilee) Mine located in Novokuznetsk, Russia in the Kemerovo Oblast at approximately 7:40 a.m. local time on Thursday [11:40 p.m. eastern time on Wednesday]. Yuzhkuzbassugol currently owns the mining facility.

The mine has already received several violations, and according to Russia’s industrial safety agency the mine would likely lose its license to operate. “Such a decision could be taken after an inquiry into all the circumstances of the accident at the Yubileinaya mine. Particularly since we have already found violations at Yuzhkuzbassugol mines.”

NYSE to merge with Archipelago; NASDAQ to buy Instinet

New York Stock Exchange (NYSE) announced last Wednesday that it has agreed definitively to merge with Chicago-based Archipelago Exchange (ArcaEx) and form a new publicly traded, for-profit company known as NYSE Group. This announcement was followed two days later by NASDAQ®, which independently announced a definitive agreement to purchase Instinet Group.

Archipelago and Instinet are innovative e-trading (electronic trading) companies, and formerly were the two largest American rivals to NYSE and NASDAQ, in recent years taking increasingly large portions of their market share. The Securities and Exchange Commission (SEC) and other regulatory agencies still have to review and approve the transactions, particularly with respect to US securities law and antitrust law, in order to ensure that the marketplace remains lawful and competitive.

Other pending issues for NASDAQ include obtaining the approval of Instinet shareholders, as well as customary closing conditions. NYSE must obtain the approval of its members and Archipelago shareholders.

These changes, a reaction to increased e-trading competition and a changed regulatory environment, will result in NASDAQ and NYSE trading each other’s shares and attempting to grab market share, which many hope will drive down transaction costs and ultimately benefit consumers. However, at least one commentator, Dan Ackman writing in Forbes, has noted that the trading commission at the NYSE currently averages less than a nickel (US$0.05) per share, and was less enthusiastic about potential efficiency gains from electronic trading at the exchange.

The transactions are also intended to make the two leading American stock exchanges more globally competitive with such exchanges as the London Stock Exchange, the Frankfurt Stock Exchange, the Toronto Stock Exchange, and the Australian Stock Exchange located in Sydney.

National Rugby League Women in League Round celebrates sons

Australia’s National Rugby League (NRL) is to celebrate “Women in League” week, starting yesterday, with themes including sons, raising funds for breast cancer support, and club-related specials to encourage women to attend rugby league games. The week-long celebration of women was started in 2006 to highlight the importance of women to the sport and make the game female-friendlier.

The NRL is planning to celebrate the week in a number of ways, including having teams compete in pink uniforms, and having fans vote for the NRL player fans believe “acts as a role model for mothers and families; someone who continues to impress us on the field, however their off-field characteristics embody what it is we love about rugby league”. Additionally, funds are to be raised for the McGrath Foundation, a charity dedicated to breast cancer support and education, and the Women in League Achievement Award will be given out with the winner earning a AU$5,000 gift card to Harvey Norman, an Australian electronics store.

The NRL has been promoting the event on their Women in League Facebook page. In the past month, their Facebook updates have included posts featuring male players discussing support they received from women in their lives, sales of pink coloured NRL merchandise, plugs encouraging people to vote for their favourite son, pictures of men supporting Women in League, NRL club promotions for tickets and other events connected to Women in League, and information on a school visit promoting anti-bullying. The Facebook page has also promoted women’s participation and profiles of women’s players as recently as a month ago, when on April 9, it promoted the Girls ‘Come and Try’ Day in Canberra. Prior to that, women were last promoted as players on February 10 when pictures were shared of the Women’s All Stars team match with the Indigenous All Stars team.

140,000 women in Australia are involved with rugby league as players, sport administrators, coaches, employees, club members, or volunteers. Karen Hardy of The Canberra Times estimates this number could easily be quadrupled if wives, girlfriends, mothers, and other female family members who support male players were included. Participation is also increasing, with almost a thousand new female players taking up the sport between 2011 and 2012 for 5,801 total registered female players in 2012.
